Mediation: The Role of The Mediator
In family law cases, mediation is a process designed to help parties resolve their disputes without the stress and often high cost of traditional litigation. The court may order mediation via a court- mandated process, or the parties’ attorneys may agree to mediation with an independent mediator. The mediator may be a mental health professional, another attorney or a retired Judge. If the mediator is an attorney, he or she should not be the attorney representing one of the parties.
